Acceptable Use Policy

This Acceptable Use Policy (AUP) applies to Your use of our Services, as defined in the General Terms and Conditions (“Terms”). Defined terms in this AUP shall have the meaning set out in the Terms.

We believe: 

• that obesity is a chronic medical condition deserving of compassionate, evidence-based treatment and care
• that all bodies are beautiful and acceptable
• that health and wellness is available at all body sizes
• that the scale is not a measure of personal worth or success

There are, however, some activities that are incompatible with Our values that, if left unchecked, could harm Us, Our employees, other participants in the Programs and other users.  The following activities are prohibited when using Our Services:

1. Disrespectful or harmful interactions: Our Services may not be used to:
   1. harass, bully, defame, stalk, threaten, or abuse another person;
   2. promote or condone hate or violence against people for any reason;
   3. engage in activities that may be harmful to others or to Our operations or reputation, including offering or disseminating fraudulent goods, services, schemes, or promotions, lose-weight-fast schemes, ponzi and pyramid schemes.
2. Illegal, harmful or fraudulent activities: You may not use Our Services in a way that contravenes, facilitates or promotes activities that are unlawful.
3. Infringement of intellectual property: You may not use Our Services in a way that infringes, or induces other parties to infringe, the copyright, trademark, or other intellectual property rights of Ours or others.
4. Malicious and / or deceptive practices: You may not use Our Services to transmit malware, for phishing or other similar inappropriate activities. You may not perform activities or upload or distribute materials that harm or disrupt the operation of Our Services or other IT infrastructure of Ours or others, including Our third party providers. You may not use Our Services for illegal or deceptive activities.
5. Misuse of personal, confidential, and protected health information: You may not post or upload any materials or use Our Services in a way that personally identifies someone or reveals sensitive personal information or confidential information, such as personal medical information, unless you have consent from the person to whom the information belongs or who is otherwise authorized to provide such consent.

You acknowledge that we (a) may monitor Your use of Our Services; (b) may investigate violations or alleged violations of the AUP; and (c) may cooperate with law enforcement authorities in prosecuting You or others in this regard.

If we reasonably believe a user is engaged in activities that violate the letter or spirit of this AUP, we may, at any time and without notice and without any liability, remove any materials, and suspend or terminate the user’s access to Our Services.

Any violation of this AUP will constitute a violation of the Terms and any other existing agreement between you and High Metabolic Clinic Inc.. Our determination of whether a violation of this AUP has occurred will be final and binding, and any action taken with respect to enforcing this AUP will be at Our sole discretion.
